Little Lacquer respects the intellectual property rights of others and expects the same respect in return. This page explains how Little Lacquer responds to claims of copyright infringement under the Digital Millennium Copyright Act (DMCA), and how to submit a takedown notice or a counter-notice if you believe content on this site infringes or was wrongly removed.
Our Commitment to Copyright
All original content published on Little Lacquer, including articles, photography, graphics, and design elements, is either created by Little Lacquer, properly licensed, or used under fair use principles with appropriate credit. Little Lacquer takes copyright seriously and will respond promptly to valid claims of infringement in accordance with the DMCA.
Filing a DMCA Takedown Notice
If you believe that content published on Little Lacquer infringes your copyright, you may submit a written notice to our designated agent. To be considered valid under the DMCA, your notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed, or if multiple works are involved, a representative list of those works
- Identification of the material you claim is infringing, including enough information to allow Little Lacquer to locate it, such as the specific URL of the page in question
- Your contact information, including a valid address, telephone number, and email address
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf
Notices that do not include all of the above may not be actionable under the DMCA and may not receive a response.
Where to Send a Takedown Notice
DMCA takedown notices should be sent to Little Lacquer’s designated agent at:
Email: dmca@littlelacquer.com
Please use the subject line “DMCA Takedown Notice” so your submission can be reviewed as quickly as possible.
What Happens After a Notice Is Received
Upon receiving a complete and valid takedown notice, Little Lacquer will review the claim and, where appropriate, remove or disable access to the material identified as infringing. Little Lacquer will make a good faith effort to notify the individual or party responsible for posting the material that it has been removed, along with a copy of the complaint, so that a counter-notice may be filed if the party believes the removal was made in error.
Filing a Counter-Notice
If you believe that material you posted on Little Lacquer was removed or disabled by mistake or misidentification, you may submit a counter-notice. To be valid, your counter-notice must include:
- Your physical or electronic signature
- Identification of the material that was removed and its location on the site before removal
- A statement, made under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification
- Your name, address, and telephone number
- A statement consenting to the jurisdiction of the federal district court for the judicial district in which your address is located, or if outside the United States, for any judicial district in which Little Lacquer may be found, and that you will accept service of process from the person who filed the original takedown notice
Counter-notices should be sent to the same email address listed above with the subject line “DMCA Counter-Notice.”
Upon receiving a valid counter-notice, Little Lacquer may forward it to the original complaining party. If that party does not notify Little Lacquer within a reasonable time that they have filed a legal action seeking a court order to restrain the reposting of the material, Little Lacquer may restore the removed content.
Repeat Infringer Policy
Little Lacquer maintains a policy of terminating, in appropriate circumstances, the access of users or contributors who are determined to be repeat infringers of copyrighted material. Multiple valid takedown notices against the same party may result in the removal of that party’s ability to submit content to Little Lacquer.
Good Faith Reminder
Filing a false or bad faith DMCA notice can expose the filer to legal liability, including damages, court costs, and attorney’s fees, under Section 512(f) of the DMCA. Please make sure your claim is accurate and made in good faith before submitting a notice.
Images and Nail Photography
Little Lacquer publishes original nail photography, styled shoots, and edited images created specifically for the site. If you believe one of your own photographs, illustrations, or other visual work has been used on Little Lacquer without permission, please follow the takedown process above and include a direct link to the original source of your work alongside your notice, as this helps our team verify ownership more quickly.
This Is Not Legal Advice
This DMCA Policy is provided for informational purposes and does not constitute legal advice. If you have specific legal questions about a copyright claim, you may wish to consult an attorney familiar with intellectual property law.
Changes to This Policy
Little Lacquer may update this DMCA Policy from time to time to reflect changes in the law or our own internal process. Any updates will be posted on this page, and continued use of the site after changes are made constitutes acceptance of the revised policy.
